    These Terms & Conditions apply to your use of www.westerwoodwhisky.com and to purchases from, or sales of whisky and other spirits to, Westerwood Whisky.

    Please read these Terms & Conditions carefully before placing an order, creating an account or agreeing to sell an item to us.

    1. About Westerwood Whisky

    The website www.westerwoodwhisky.com (“our website”) is operated by Westerwood Whisky (“Westerwood Whisky”, “we”, “us” or “our”).

    We are an independent online whisky retailer based in Scotland, specialising in the purchase and sale of whisky and other spirits.

    By using our website, creating an account, placing an order or agreeing to sell goods to us, you agree to these Terms & Conditions together with our Privacy Policy and any other policies referred to on our website.

    Nothing in these Terms & Conditions affects your statutory rights as a consumer.


    2. Using Our Website

    You are responsible for ensuring that all information you provide to us is complete, accurate and kept up to date.

    If you create an account, you are responsible for keeping your login details and password secure. You must not knowingly allow another person to use your account without your permission.

    We reserve the right to suspend or close an account where we reasonably believe that:

    • false or misleading information has been provided;

    • the account is being used fraudulently or unlawfully;

    • our Terms & Conditions have been breached; or

    • continued use of the account could cause harm to Westerwood Whisky, our customers or another party.


    3. Age Restrictions

    You must be 18 years of age or older to purchase alcohol from Westerwood Whisky or to sell alcohol to us.

    By placing an order or agreeing to sell alcohol to us, you confirm that you are legally permitted to do so.

    We operate an age-verification policy and may request proof of age where required.

    Deliveries containing alcohol may be subject to Challenge 25. The recipient may be required to provide valid photographic identification showing their date of birth before the parcel is released.

    Acceptable identification may include a passport, photocard driving licence or other recognised photographic proof-of-age document.

    If appropriate identification cannot be provided, delivery may be refused and the parcel returned to us. Where legally permitted, the customer may be responsible for reasonable return or re-delivery charges arising from a failed age-verification check.

    For international orders, customers must also meet the legal drinking age and any applicable alcohol regulations within the destination country.

    4. Products & Descriptions

    We take reasonable care to ensure that product descriptions, photographs, bottle details, ages, strengths, vintages, packaging and other information displayed on our website are accurate.

    Many products sold by Westerwood Whisky are rare, discontinued, vintage or collectable bottles. The condition of bottles, labels, seals, capsules and presentation packaging may therefore vary.

    Where we are aware of material damage, deterioration or other relevant condition issues, we will endeavour to show or describe these within the product listing.

    Product photographs may form part of the product description, particularly for rare, older or collectable bottles.

    Older bottles may naturally display signs of age including label wear, fading, staining, changes to fill level, deterioration of packaging or wear to capsules and closures.

    If the condition of a particular bottle or its packaging is important to you, please contact us before purchasing if you require any additional information.


    5. Product Availability

    All products are subject to availability.

    Placing an order does not guarantee that a product remains available. Very occasionally, an item may have been sold elsewhere, incorrectly listed or found to be unsuitable for sale before dispatch.

    If we are unable to fulfil your order, we will contact you and refund any payment made for the affected item.

    We will not substitute another product without your agreement.


    6. Prices & Payment

    All prices are displayed in the currency shown on our website.

    Applicable VAT will be included or otherwise dealt with in accordance with current UK tax legislation.

    Delivery charges and any other applicable charges will be displayed before you complete your purchase.

    Payment must be made using one of the payment methods available at checkout.

    We reserve the right to correct genuine pricing, description or technical errors.

    If an obvious pricing error is discovered after an order has been submitted but before the goods have been dispatched, we may contact you to offer the option of proceeding at the correct price or cancelling the affected item for a full refund.


    7. Order Acceptance

    After placing an order, you may receive an automated email confirming that we have received it.

    This acknowledgement does not necessarily constitute acceptance of your order.

    A contract for the purchase of goods is formed when we accept and process your order for dispatch, unless expressly agreed otherwise.

    We reserve the right to decline or cancel an order where reasonably necessary, including where:

    • a product is unavailable;

    • a genuine pricing or listing error has occurred;

    • payment cannot be authorised;

    • we cannot verify age or identity where required;

    • we are unable to deliver to the address supplied;

    • we reasonably suspect fraudulent or unlawful activity; or

    • completing the transaction would breach a legal or regulatory requirement.

    If we cancel an order after payment has been received, the relevant payment will be refunded.


    8. Delivery

    Available delivery methods and charges will be displayed at checkout where possible.

    Any delivery times shown are estimates unless we expressly confirm a guaranteed delivery service.

    We take care to securely package bottles using packaging appropriate for the nature and value of the goods.

    Where we arrange delivery to a consumer, the goods remain our responsibility until they are received by you or another person nominated by you to receive them.

    Please inspect your delivery as soon as reasonably possible after receipt.

    If a parcel or bottle arrives damaged or leaking, please contact us promptly at info@westerwoodwhisky.com.

    Please retain all packaging and, where possible, provide photographs showing:

    • the outer packaging;

    • internal packaging;

    • the affected bottle or bottles; and

    • the delivery label.

    This will allow us to investigate the matter with the delivery provider.

    Your statutory rights in respect of damaged, faulty or incorrectly supplied goods are not affected.


    9. International Delivery

    Westerwood Whisky may deliver to selected international destinations.

    Availability, charges and estimated delivery times will vary according to destination.

    Customers are responsible for ensuring that alcohol can legally be imported into and received within their destination country.

    International orders may be subject to customs duties, import taxes, local taxes, clearance fees or other charges imposed by authorities within the destination country. Unless expressly stated otherwise at checkout, these charges are the responsibility of the recipient.

    Customs procedures and local delivery requirements may result in delays outside our control.

    We reserve the right to restrict or refuse delivery to countries or regions where shipping alcohol is prohibited, impractical or subject to restrictions which we cannot reasonably satisfy.


    10. Cancellation & Change-of-Mind Returns

    If you purchase from Westerwood Whisky as a consumer online, you will normally have a legal right to change your mind and cancel your purchase without giving a reason.

    For most eligible purchases, you have 14 days from the day after you receive the goods to notify us that you wish to cancel.

    Cancellation requests should be sent to info@westerwoodwhisky.com.

    Please provide your name, order number and details of the item or items you wish to return.

    Once you have notified us that you wish to cancel, the goods must be returned to us within 14 days.

    Condition of Returned Bottles

    Due to the nature and value of the products sold by Westerwood Whisky, particularly rare, vintage and collectable whisky, change-of-mind returns will only qualify for a full refund where the item is returned in the same condition as it was supplied.

    All bottles must be returned fully sealed and unopened, with the original seal, capsule and closure completely intact.

    All presentation boxes, packaging, certificates, booklets and other accompanying items must also be returned in the same condition as supplied.

    Any bottle that has been opened, consumed, had its seal or closure broken or tampered with, or has otherwise been altered from the condition in which it was supplied will not qualify for a full refund.

    Where the bottle itself remains sealed but the bottle, label, presentation packaging or accompanying materials have been damaged, altered or are missing, Westerwood Whisky reserves the right to reduce the refund to reflect any reduction in the value of the item, to the extent permitted by law.

    This condition applies to change-of-mind returns only and does not affect your statutory rights where an item is faulty, damaged when delivered, incorrectly supplied or not as described.

    Returning an Unwanted Order

    Where an order is being returned because you have changed your mind, you are responsible for the cost of returning the goods to us, except where applicable law requires otherwise.

    Due to the fragile and potentially high-value nature of our products, returned bottles must be securely packaged.

    We strongly recommend using an appropriately insured and fully trackable delivery service.

    Where you arrange the return carrier yourself, you are responsible for ensuring that the goods reach us safely, subject to your statutory rights.


    11. Refunds

    Where you validly exercise your statutory right to cancel an eligible purchase, we will refund the price paid for goods returned in accordance with these Terms & Conditions, subject to any deductions permitted by law.

    Where required by law, we will also refund the cost of our least expensive standard delivery option.

    If you selected an enhanced, express or premium delivery option, any additional cost above our least expensive standard delivery service will not normally be refunded.

    We may withhold your refund until we have received the returned goods or you provide satisfactory evidence that they have been returned, whichever occurs first.

    Refunds will be processed within the timescales required by applicable consumer law and will normally be made using the original payment method.

    If goods are faulty, damaged during delivery, incorrectly supplied or materially not as described, please contact us promptly.

    Where appropriate, we will provide the remedy required under applicable consumer law, which may include a refund or replacement depending on the circumstances.

    Where we are legally responsible for the return of faulty, damaged, incorrect or misdescribed goods, we will meet reasonable return costs.


    Selling Whisky to Westerwood Whisky

    12. Selling Bottles to Us

    Westerwood Whisky may offer to purchase whisky and other spirits directly from private individuals, businesses or other sellers.

    Any initial valuation or purchase estimate is based on the information and photographs supplied to us and remains subject to inspection of the physical item.

    Unless expressly stated otherwise, an initial valuation does not oblige Westerwood Whisky to purchase the bottle.

    Once we receive an item, we may inspect its:

    • authenticity;

    • bottle condition and fill level;

    • seal or closure;

    • capsule;

    • labels;

    • presentation box or packaging;

    • signs of leakage or damage;

    • provenance, where relevant; and

    • conformity with the information previously supplied to us.

    Following inspection, we may confirm the original valuation, provide a revised offer or decline to purchase the item.

    The seller is under no obligation to accept a revised offer.


    13. Seller Descriptions & Authenticity

    Sellers must provide accurate information about any bottle offered to Westerwood Whisky and disclose any known damage, defects, leakage, alterations or concerns regarding authenticity or provenance.

    By selling an item to Westerwood Whisky, you confirm that:

    • you are legally entitled to sell the item;

    • you are the lawful owner or have authority from the lawful owner to sell it;

    • the item is authentic to the best of your knowledge;

    • you have not knowingly concealed any material defect or alteration; and

    • the sale does not infringe the rights of another person.

    We reserve the right to refuse any item that we reasonably believe to be counterfeit, altered, stolen, unlawfully obtained or materially different from the item described to us.

    Suspected counterfeit, stolen or unlawfully obtained goods may be reported to the appropriate authorities where appropriate or required by law.

    Information relating to the seller and goods may also be supplied to the relevant authorities where required or permitted by law.


    14. Sending Bottles to Us

    Unless we expressly agree to arrange collection, sellers are responsible for safely transporting bottles to Westerwood Whisky.

    Bottles should be securely packaged and sent using an appropriate, trackable and adequately insured delivery service.

    Where the seller selects and arranges their own delivery service, Westerwood Whisky will not normally be responsible for loss or damage occurring before the goods are delivered into our possession.

    Where we arrange collection ourselves, any applicable collection arrangements will be agreed with you.


    15. Items We Decline to Purchase

    If, following inspection, we decide not to purchase an item, we will contact the seller.

    The seller will be responsible for arranging collection or paying the reasonable cost of returning the item unless otherwise agreed.

    Items should be collected or return arrangements agreed within a reasonable period following notification.

    We will take reasonable care of items while they remain in our possession.


    16. Payment to Sellers

    Once a purchase has been agreed and completed, payment will normally be made by bank transfer unless another payment method has been agreed.

    Sellers are responsible for providing us with accurate payment information.

    Westerwood Whisky will not be responsible for delays resulting from incorrect bank details supplied by the seller, although we will take reasonable steps to assist in resolving genuine payment errors.

    We may request additional identification, proof of ownership or other verification before making payment where reasonably necessary for fraud prevention, legal compliance or verification purposes.

    Unless otherwise agreed in writing, ownership of the goods will pass to Westerwood Whisky once the purchase has been completed and the agreed payment has been made.


    General Terms

    17. Authenticity

    We take the authenticity of products we purchase and sell seriously.

    Rare, vintage and collectable spirits can vary considerably in age, appearance, packaging and condition. We inspect products using information reasonably available to us and may seek additional specialist advice where appropriate.

    If you have a genuine concern regarding the authenticity of an item purchased from Westerwood Whisky, please contact us promptly at info@westerwoodwhisky.com.

    Please provide full details of your concern together with photographs or other supporting information where appropriate.

    Nothing in these Terms & Conditions excludes your statutory rights where goods are not as described or where we do not have the legal right to sell them.


    18. Vintage & Collectable Bottles

    Older and collectable bottles may naturally display signs of age, including label wear, fading, staining, evaporation, changes to fill level, deterioration of packaging or wear to closures and capsules.

    The purchase of vintage and collectable spirits can therefore involve characteristics which would not normally be present in newly manufactured products.

    Where such characteristics are visible or known to us, we will endeavour to accurately represent them within the product photographs and description.

    We cannot guarantee the flavour, drinkability or continued integrity of the contents of an older sealed bottle where deterioration has occurred naturally with age and could not reasonably have been identified without opening the bottle.

    Nothing in this section excludes liability for goods which have been materially misdescribed or any other liability which cannot lawfully be excluded.


    19. Privacy & Personal Information

    We process personal information in accordance with applicable UK data-protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

    We may process information for purposes including:

    • processing and fulfilling orders;

    • arranging deliveries and collections;

    • processing payments;

    • making payments to sellers;

    • customer service;

    • fraud prevention;

    • age and identity verification;

    • complying with our legal and regulatory obligations; and

    • operating and improving our business.

    Where necessary, information may be shared with relevant service providers including payment processors, delivery providers and professional advisers.

    We may also disclose information to regulatory, law-enforcement or other authorities where required or permitted by law.

    20. Our Liability

    Nothing in these Terms & Conditions excludes or limits any liability which cannot lawfully be excluded or limited.

    This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and your statutory consumer rights in relation to faulty, damaged or misdescribed goods.

    Subject to these rights, Westerwood Whisky will not be responsible for losses which were not reasonably foreseeable when the contract was entered into or which arise from circumstances outside our reasonable control.

    Where goods are purchased wholly or mainly for business purposes, we will not be responsible for indirect or consequential business losses including loss of profits, revenue or business opportunity except where liability cannot lawfully be excluded.


    21. Events Outside Our Control

    We will not be responsible for unreasonable delay or failure to perform an obligation where this results from circumstances genuinely outside our reasonable control.

    These circumstances may include severe weather, natural disasters, fire, flood, epidemic or pandemic, industrial action, civil disturbance, terrorism, war, interruption to transport networks, governmental restrictions or significant disruption to utilities or communications.

    Where circumstances outside our reasonable control affect an order, we will take reasonable steps to minimise disruption.

    Your statutory rights are not affected.


    22. Intellectual Property

    Unless otherwise stated, content on the Westerwood Whisky website, including our branding, logo, written content, graphics and original photography, belongs to Westerwood Whisky or is used by us with permission.

    Our content must not be copied, reproduced, distributed or used commercially without our prior written permission except where permitted by law.


    23. Website Availability

    We aim to keep our website available, secure and accurate but cannot guarantee uninterrupted access or that the website will always be free from technical errors.

    We may temporarily suspend or restrict access for maintenance, security, updates or other reasonable operational purposes.


    24. Changes to These Terms & Conditions

    We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or applicable law.

    The Terms & Conditions applicable to an order will normally be those in force at the time the order was placed.

    Changes made after a contract has been entered into will not remove or reduce rights which have already arisen under that contract.

    The latest version of these Terms & Conditions will be published on our website.


    25. Governing Law

    These Terms & Conditions and contracts entered into with Westerwood Whisky are governed by the laws of Scotland.

    If you are a consumer, this does not deprive you of any mandatory consumer protections available to you under applicable law.

    Any dispute will be dealt with by the courts having jurisdiction under applicable law.
